Roe v Wade: The Rise of Fascism in the US

As I wrote last month, there is a rising tide of fascism in the United States. The United States Supreme Court is one of the cudgels to roll back the rights of women. That earlier piece was in the context of Disney, and Critical Race Theory. This is in that continuum in a war of the minority against the majority. It is an attack on community and resiliency.

These are leaks from the Supreme Court, which are unprecedented in the United States. What Politico is reporting is an attack on women’s rights to their own bodies.

The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.

The full leaked draft decision is here.

Leaks from the court are extremely rare. So is the use of the shadow docket, which has been abused this term. But I am not going to deal with the inside Washington process. Rather the effect this will have.
